Deprivation of Rights Under Color of Law
Applies to every single lockdown in this country that I know of, including the original "15 days to slow the spread".
I’ve previously discussed how the founding fathers of this country made a mistake in not spelling out punishments for violating the Constitution, and that article provides some very good context and additional information including Obama’s disdain for the Bill Of Rights:
You’ve got treason spelled out and that’s about it. While I’m sure good arguments can be made that the Corona scamdemic/plandemic lockdowns were indeed treason, that’s not the best route to go.
It turns out that there is a federal law that does cover the topic, however. Please read it carefully. You do NOT need to be a judge or an attorney to understand it. Try to envision, just from the words in the statute and not what some left wing judge or any other left winger has said, how any claimed “emergency powers” get around this law, especially if you didn’t think the Constitution already prohibited lockdowns for illnesses or other scares:
TITLE 18, U.S.C., SECTION 242
Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.
The official DOJ webpage linked above (and by clicking the picture) has an additional explanation section just before the text of the statute:
If you think there is language in the Constitution that allows for suspending the Bill Of Rights if people get sick, by all means read the whole thing. There is a provision for imposing martial law in the event of invasion or insurrection, but a respiratory virus is neither of those, and no lockdown anywhere was deemed martial law. In fact certain business were allowed to remain open the entire time while churches and other venues were forced to close. Even gatherings of family members at private homes were prohibited in some areas.
Protests against lockdowns were also prohibited. Meanwhile Saint George Floyd protests were allowed and even encouraged by the left. Never mind that Floyd was a career criminal with multiple convictions*, and the last one was one where he held a gun to the abdomen of a pregnant woman as his fellow felons robbed her home, but I digress.
So every single lockdown in this country that I am aware of prohibited the free exercise of religion, and prohibited the right to assembly to everyone who was not an America hating left wing radical. So two provisions of the 1st amendment were clearly and very blatantly violated.
Looking at the 9th amendment:
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
and then reading the Declaration Of Independence, you can see that the 9th was also clearly violated, as both “liberty” and “pursuit of happiness” were impaired or prevented by lockdowns, and the 9th covers these.
The unanimous Declaration of the thirteen united States of America, When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.
We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, …
Of course any true Conservative treats the Declaration Of Independence as a founding document that goes hand in hand with the Constitution. The point about rights coming from God, as opposed to coming from government, is absolutely critical. With respect to my arguments here, this just shows more clearly how the lockdowns were an illegal violation of rights.
Interestingly, Trump’s comments even this week about how great the “vaccines” are and how they’ve saved 100 million lives (!!!!!), and many Trump supporters expressing shock at the idiocy of those comments, has brought out some pathetic arguments that Trump is not at all to blame for the lockdowns, and in fact he’s not at all to blame for anything with respect to the Corona response. (!!!!)
The “15 days to slow the spread” is glossed over or completely dismissed, and then the 10th amendment is bizarrely trotted out to place blame for the lockdowns on the states. Javon Price (@JavonAPrice), who apparently had some role in the Trump administration, made this argument in response to me in a Twitter space recently.
Javon is by no means the only one to spout “10th amendment” to excuse Trump failing to prevent state level lockdowns in 2020 (While also ignoring the original unconstitutional “15 days to slow the spread” that Trump authorized at the federal level.), but the number of people making the claim does not excuse the obvious left wing level dishonesty of any “10th amendment” argument.
Obviously, as I’ve noted above, two provisions of the 1st amendment were being blatantly violated. No ifs, ands. or buts about it.
And again, there is NO language in the Constitution voiding the Bill Of Rights if people get sick!! NONE!!!
We don’t even get to the 10th amendment. We’re done, right at the 1st amendment, and TITLE 18, U.S.C., SECTION 242 applies such that any governor, mayor, or other “official” violating the Bill Of Rights should have been immediately arrested by federal authorities. Of course Trump and company themselves were in violation of TITLE 18, U.S.C., SECTION 242 as soon as they started “15 days to slow the spread”. Not even Trump had that authority. Not even close.
I realize this will aggravate some blind Trump loyalist readers here, but so be it. Trump is not perfect, and NO ONE should be claiming he is, nor should they be downplaying the horrid consequences of his going along with any lockdown. If you expect Trump to do the best job representing the interests of the American people, which includes upholding the Constitution above all else, you MUST hold him to account when he fails. Blind loyalty and an endless string of excuses will NOT work.
Not only were the lockdowns, including the first “15 days to slow the spread”, disastrous for the U.S. economy and damaging to far more lives than were at risk from Corona, they were also USELESS at stopping the spread of Corona, and they were also a signal to left wing tyrants everywhere that even hard core non politician Donald Trump would allow authoritarian lockdowns. The flood gates were opened, and the tyrants poured right through them and reveled in being able to get away with actions probably beyond their wildest dreams in the past.
On a related note, blind Trump loyalists make another another left wing style argument. Trump is a strong and powerful leader, a great leader, and a great president. But somehow he is blameless for the epic fail at the Corona response even though he left little Fauci, Birx, and other left wing bureaucrats in charge to screw things up and in the process screw him and the American people over. (???)
The man famous for the two words “You’re fired!” failed to fire some of the absolute worst clowns in government ever, but he is blameless. (???!!!) And Trump trusted big pharma to create “safe and effective” “vaccines”, even though big pharma have clearly been engaged in criminal enterprises for decades and have paid out billions in fines for it, but he is still blameless for that misplaced trust. (???!!!)
Trump had great policies and great success up until March of 2020, there is no question about that. But the analogy that comes to mind is an NFL team’s performance. With a 17 game regular season in the NFL now, it’s like Trump’s team went something like 12 and 2 to start out so the playoffs were already clinched, but then lost the last 3 games of the regular season badly, and then lost in the first round of the playoffs in a blowout.
But somehow head coach Trump has no responsibility at all for those losses. (???) When something like that happens in football do you think a large number of the fans of the team say the coach didn’t make any mistakes at all??
I have to ask the blind loyalists where, exactly, did the buck stop in 2020?? If it didn’t stop with Trump, was he really a strong, powerful leader doing a great job???
Of course a typical response to my points about the Constitutional violations, whether defending Trump or more likely defending the left wing tyrant governors, is the “lives saved” lie. The problem is that it does not matter whether the original wild fear mongering claims of 3% or 4% of people who got Corona would die from it were true, or if it was actually 10%, or 20%, or even more who died.
It doesn’t even matter if the lockdowns actually worked to stop the spread of Corona. Again, they were a horrible failure that only did damage, and in fact enabled left wingers to greatly expand mail in voting such that it was easier for them to commit the massive fraud that cost Trump the election.
Ponder Trump never allowing any lockdowns and threatening to arrest any governor trying to do so, while at the same time constantly spreading the factual news of just how non deadly Corona was versus the wild fear mongering of the left. The mass mail in voting changes may have been stopped in every state where those changes were made, and the 2020 election may not have been stolen from Trump, and thus we’re not in the current Biden hell we have now. That very real possibility alone is reason enough to put responsibility on Trump.
In any event, the Constitution does NOT have provisions to simply suspend the Bill Of Rights if an illness is killing people! You can NOT get around that!! There are no valid “emergency powers” enshrined in the Constitution other than a declaration of martial law for an invasion or an insurrection, and those did NOT apply and no tyrant claimed that they were imposing martial law either.
If you think a certain death toll threshold makes it okay to violate the Constitution you are horribly wrong on multiple fronts. First, the death tolls were obviously being inflated starting very early on. Second, tyrants have a long history of fear mongering in order to gain and/or increase their power.
If you set a threshold of infection fatality where you decide it’s okay to let tyrants be tyrants, those tyrants will make absolutely certain that the projections as well as the supposedly real data will exceed that threshold such that they can claim that they do have authority to impose their tyranny. Never forget that. Tyrants will never “let a crisis go to waste”! And they will create them if they can.
Any other fear threshold you set in other areas is the same story. The global warming scam is a great example that has been going on for over 30 years. The scare level has been constantly increasing, and now with the wild success of the Corona scamdemic there are plenty of left wingers talking about a “climate emergency”. You either get over your irrational fears of illness and everything else the lying left wingers can and will come up with, or you doom yourselves and your children and grandchildren to tyranny.
And no matter how much you love Trump and no matter how many light years he was and is better than Joe Biden’s puppeteers that are destroying this country, you do NOT excuse Trump for enabling any of the damage because he failed to fire various evil bureaucrats and also failed to follow the Constitution.
Change my mind, without trying to make up pathetic claims about the 10th amendment.
* Try searching for “George Floyd’s criminal convictions” with or without the quotes to see just how bad the left wing bias in search is. Try with multiple different search engines too. Instead of the first 5 or more results properly being simple listings and descriptions of Floyd’s convictions, you’ll get multiple “fact checks” and other left wing spin sites, and you’ll probably need to scroll way down to find a conviction listing, if it’s there at all.
Most of the spin sites will state that Floyd went to Minnesota in 2014 to start fresh, and they’ll diminish or even leave out how Floyd was high on fentanyl and other drugs when the police were called on him for trying to pass a counterfeit $20 bill:
George Floyd moved to Minnesota to start a new life shortly after being released from prison in Texas, but his pursuit of a better life ended tragically when he died during a violent arrest
It’s safe to assume that George Floyd was NOT a model citizen in Minnesota in the 5 or 6 years between when his last prison stint ended in 2014 and his drugged up passing of the fake $20 bill in 2020.

Granted, it doesn't exonerate Trump, but it suggests that he was outfoxed by the real bastards, Fauci and Birx. And also, the fact that so much responsibility falls on Trump is a little ironic. It seems to me that Trump, unlike every other President since...um, Eisenhower?...really believed in allowing people to do what they wanted without unnecessary interference from gov't. In that perspective, I can't quite picture him taking a knee to the shut-everything-down crowd. Besides, he was a hotelier and saw the economy through that lens. Lockdowns would have been an anathema to him.
Brilliant! I should have refused to mask everywhere I went and made the establishments call the police and arrest me. If I had done that, I could now be swearing out complaints against the police, at the very least. We're not as helpless against this kind of authoritarian abuse as I thought we were. Thanks, Chris!
